Arcadian here it is:

This man will be 78 this year, lives with his wife.  We've been here 14 years and have no lease........

Sorry for the delay missed your post  Smiley

Firstly do you still definitely want to go down the legal route and get clear information on your position ?

If yes, then whether you live in the Toronto area or not you're best off ringing the phone number below as soon as possible.

http://www.torontotenants.org/hotline.htm

In other words as soon as you've read this post - especially as the weekend's coming up when they'll be closed. If you don't live in the area then ask for the name of a similar organisation around where you live and get onto them asap. Then explain the whole situation to them and ask what immediate action to take. They'll probably say do nothing until you've had your free appointment with them when you can then bring up everything that has caused you problems over the years. However do NOT mention any of this to any of the other tenants at all as they might warn him and that is the VERY last thing you want !! Just keep it all close to yourself until you have had full professional advice as to what's best to do.

Remember it's the legal UK, probable Canadian scene ONLY we're talking about here. Nothing on any personal levels.

My thoughts in the meantime are that it's very important to keep up with all your rental payments, whatever they are, so that he can't complain or cause any legal backlash problems for you both later on, as he could then claim all sorts of imaginary rubbish ! And that's what you must avoid at all costs at this specific stage, i.e. do NOT give him any legal grounds for complaint against you now at all. This is also important as it will make life from all legal standpoints a whole lot easier for you later on as the tenant.

In fact I guessed he might be quite old as some old landlords can get very lazy and can't be bothered to keep up to date with new tenant/ landlord issues. Especially if no-one has ever really said anything to him whereas younger landlords tend to stay on top of things. I can't really follow the discount he's referring to as he also doesn't say how long it's all supposed to last, but to use the word "appreciate" is pretty iffy and comes across to me anyway, as potential tenant harassment. However this must be up to your legal adviser to decide of course. Nevertheless take a couple of photocopies of it in case you lose the original as it will always be your main piece of legal evidence. Did he sign it and date it by the way ? It's important that he did for obvious reasons.

One thing I'm not quite clear on though is when you said you have "no lease". Was there no written legal agreement or anything between you before you moved in, as that would be unusual and something you'd definitely want to bring up when you have your first meeting with a legal adviser. How much notice you both have to quit etc. ? Anything tucked away you might have forgotten about ? Have a good rummage round first for all relevant old paperwork beforehand. On the other hand providing you have had some form of receipt or a rent book for all your rental payments that's a big help, because his very acceptance of the rent/ money constitutes a formal and legal transaction in itself. However if he starts playing around or refuses to admit or show such evidence, any Court, certainly in the U.K. so it's likely to be the same in Canada, can issue an Order to submit all his tenancy files etc. and bank statements for the Court's inspection. Banks also have to comply with such Orders too. And if he still refuses, and he sounds sufficiently cantankerous to do so, the Court can then issue a Warrant carried out by the police to search his place. Regardless. Additionally he might also find himself in Contempt of Court which puts him really up s... creek without a paddle.

Which above all else is why you must always keep your own nose absolutely legally clean throughout this whole process so he never has the opportunity for a legal comeback on you.

However !! Even when it's all over you're still going to have to see him on occasions. It’s inevitable. The question is do you really want to go through all this legal process to begin with ? Or would it be better to save yourself all the headache and worry now and find someplace else ? In your shoes and from what you've said so far this is what I would do, start looking asap because it's always going to leave a sour taste in your mouth. Plus he might decide to be worse than ever in the future without breaking any legal rules as they can get very crafty, mean and cunning when hated old age is creeping up on them ! Then you're back to tenant harassment and the whole lot all over again. And as he also sounds the type to nurse grudges and all this could drag on for quite a few months in any case, why bother having to put up with such genuflection any more ?

I think perhaps you're best out of it as soon as possible don't you ? Life's too precious and short to waste on all these useless types so why not buy yourself some time, once you've had the necessary and important legal meeting, to look around ? Up to you of course and hope this gives you some idea of what might lie ahead, but I'm afraid this is as far as I can take it now Smiley

Good luck whatever you decide !

Cadie

Thanks Arcadian, I know it will be hard and wish I could move but money does not allow that. Embarrassed Cry  I am waiting for him to make a bad mistake, one of which will put him in jail.

Dear Hair Diary,

Whew its still hot in my neck of woods!  We went out for dinner at Subway lastnight, the place is always freezing cold there and that was a relief. I use to post on the henna page a few years ago and stopped by lastnight to say hi and posted a pic of my hennaed hands.  Well, they deleted my post.  I was so sad Cry...

Anyway hair got washed yesterday.  The fans have made it feel dry along with my skin so I made sure it was nice and oiled.  I cannot wait for the weather to break so I can bellydance!!  My meds make me even hotter so I have to take it easy. (boring!!!!) Must measure my hair!

bye for now! Cool

I'm so sorry you are having such difficulties with your landlord.  I hope you are able to find some reasonable solution.

I love the henna!  Very interesting.

As for keeping cool in the heat..... a trick I learned as a kid in an un-air conditioned school during an early heat wave is to run cold water over your pulse points.... the inside of your wrists, your ankles and your neck.  This will cool your whole body.  Try soaking a bandana in cold water and wear it around your neck (or see if you can find a "cool tie").  Or just run your wrists under cold water.  It i amazing how quickly your will feel more comfortable.

Cheesy  I made friends with a billy goat!  I love to pet the farm animals!  My niece is afraid of chckens for some reason so I picked up a hen and showed there's nothing to be afraid of.  There were lots of bunnies and genuie pigs to pay with.  I can home filthy but I loved it!!

Dear Hair Diary,

It was really humid lastnight and my hair curled all up!  It looked really nice.  I am back to bellydancing as the weather has subsided a bit.  My lime pickle is doing great!   Yesterday and e-bay seller pissed me off!  I wish people could get there act together! Angry  Anyway, a rode crew is braking up the street outside and I can barely hear myself think!!

bye for now! Tongue

Dear Hair Diary,

Yawn!  Had trouble sleeping lastnight, was feeling a bit sore from dancing.  I try not to take too many aspirins as I know there bad for my stomach....  Pets can be such a comfort!  I was feeling down yesterday and my bunny really made me feel better, bless the little guy....

I have been doing WO rinses with my hair and its been behaving quite well.  I just have to make sure to do a light oiling or add a drop of Ojon.  Today is wash day and to my grief I will be having the pumbler in to fix a leaky tap.  And yes the landlord will be here too. #$%^!...

Anyway got to get hubby up for work.

Bye for now!...

This is what I do, wet hair in shower then pour a pitcher full of water that has a little squirt of AVC in it.  This is great for sweaty hair that doesn't need to be washed and helps me cool off after dancing. Cool

Ok cool.  I will think about that for the days I 'run' during lunch.  Do you use conditioner after?  I don't know if my hair would take not being conditioned...it is soooooo fine it knots easily.  I usually just rinse and condition...skip the poo.

With this method I do not use conditioner but make sure I oil or Ojon afterwards. Wink

Dear Hair Diary,

Hairs been doing good not much to report.  Yesterday was mayhem!  I had my MIL over and my friend S.    I don't think its fair for mum to order me around in my own place.  She damn well knew I had next  zero food in the house and that hubby did not get his pay this week (his boss is a an A**) But she demaned dinner.  All I had was duck eggs and bread, and a little milk  God I thought it was so rude!  Look I will feed anyone who comes over no matter who you are but for heaven's sake don't demand it!  Our friend S was like don't worry about me, he even had his tea black to save the milk.  I think what really got me mad was when she tried to tell me how to cook the eggs!  Like I don't know how to cook!  And of couse she has to be the center of attention and act like the Queen of England.  I just wanted to go to bed. On top of that she hates S because he's gay, so you can imagin how she treated him.  I don't know where the heck I got the patiens....

Ahh, MIL's...aren't they fun? Scrutinizing your every breath because you're just not good enough for her boy. Ugh! So glad I don't have to deal with that anymore!  Tongue

Good news is it's a new day and she's not there to terrorize you anymore, right? *hugs*
